បងប្អូនជនរួមជាតិជាទីគោរពស្រឡាញ់! មិត្តភក្តិបរទេសជាទីរាប់អាន! មកដល់ពេលនេះបងប្អូនជនរួមជាតិ និងមិត្តភក្តិបរទេសប្រហែលជាអាចយល់បានហើយថា ហេតុអ្វីបានជាខ្ញុំសម្រេចចេញបញ្ជាឲ្យក្រសួងការបរទេស និងតំណាងកម្ពុជាយើងដែលចូលរួមមហាសន្និបាតអង្គការសហប្រជាជាតិ បោះឆ្នោតប្រឆាំងរុស្សុី ដែលវាយចូលប្រទេសអ៊ុយក្រែនកាលពីឆ្នាំ២០២២ ដែលធ្វើឲ្យប្រទេសជាច្រើនមានការភ្ញាក់ផ្អើលអំពីឥរិយាបទរបស់កម្ពុជា។ ខ្ញុំគិតថាថ្ងៃណាមួយ ថៃនឹងធ្វើសកម្មភាពដូចកាលពីឆ្នាំ២០០៨ ដល់ឆ្នាំ២០១១ទៀតហើយ។ ពេលនេះភាពគឃ្លើនមិនគោរពច្បាប់បានបង្ហាញចេញមកហើយ។ ដូចនេះគេអាចពន្យល់បានហើយអំពីការគិតរបស់ខ្ញុំសម្រាប់ពិភពលោក ដែលគោរពច្បាប់ផង និងសម្រាប់អនាគតកម្ពុជា ជាមួយប្រទេសថៃផង។ កម្ពុជាអំពាវនាវដល់បណ្តារដ្ឋដែលអនុវត្តនយោបាយការបរទេសផ្អែកលើច្បាប់ លើកទឹកចិត្តដល់ភាគីទាំងពីរដោះស្រាយបញ្ហាដោយសន្តិវិធី និងគោរពតាមច្បាប់។ សំណូមពររបស់កម្ពុជា គឺស្នើសុំឲ្យបណ្តារដ្ឋ ដែលគោរពច្បាប់ លើកទឹកចិត្តភាគីថៃ ដំណើរការក្តីតាមផ្លូវតុលាការយុត្តិធម៌អន្តរជាតិ ICJ លើសំណុំរឿងព្រំដែនជាមួយកម្ពុជាលើ៤ចំណុច៖ ទី១ តំបន់មុំបីនៃព្រំដែនកម្ពុជា-ឡាវ-ថៃ ទី២ ប្រាសាទតាមាន់ធំ ទី៣ ប្រាសាទតាមាន់តូច និង ទី៤ ប្រាសាទតាក្របី។ កម្ពុជាមិនស្នើសុំអាវុធ-គ្រាប់ ដើម្បីវាយប្រយុទ្ធបង្ហូរឈាមគ្នារវាងកម្ពុជានិងថៃនោះទេ តែកម្ពុជាស្នើសុំឲ្យលើកទឹកចិត្តដោះស្រាយដោយសន្តិវិធីតាមរយៈការចរចា តាមយន្តការទ្វេភាគីផង និងតាមផ្លូវតុលាការផង។ ព្រំដែនកម្ពុជា-ថៃមានប្រវែងជាង៨០០គីឡូម៉ែត្រ កម្ពុជាលើកតែ៤ចំណុច ដែលជាចំណុចក្តៅ និងរសើប ដែលងាយនឹងផ្ទុះអាវុធវាយប្រហារគ្នាប្តឹងទៅតុលាការដោះស្រាយជាមុន។ ៤ចំណុចដូចបានរៀបរាប់ខាងលើ មិនអាចរកការស្រុះស្រួលគ្នាតាមយន្តការទ្វេភាគីបានឡើយ សូម្បីតែ១០០ឆ្នាំទៀតក៏មិនអាចដោះស្រាយបានដែរ។ ដូចនេះមានតែតុលាការយុត្តិធម៌អន្តរជាតិ ICJ ប៉ុណ្ណោះ ទើបអាចដោះស្រាយបាន។ ការដោះស្រាយតាមផ្លូវតុលាការមិនមែនជាការបង្កហេតុបង្កសង្រ្គាមនោះឡើយ តែជាការដោះស្រាយដោយសន្តិវិធីតាមផ្លូវច្បាប់បញ្ជៀសការបង្ហូរឈាមនាពេលអនាគត។ សម្រាប់រាជរដ្ឋាភិបាលក៏ងាយស្រួលក្នុងការបកស្រាយជាមួយប្រជាជនខ្លួនផងដែរ ក្នុងករណីចាញ់ក្តីនៅតុលាការ។ ក្នុងចំណោមប្រទេសអាស៊ានមានឧទាហរណ៍ដ៏ល្អ ដែលឥណ្ឌូនេសុី និង ម៉ាឡេសុី, សឹង្ហបុរី និងម៉ាឡេសុី នាំយកជម្លោះទឹកដី ទៅឲ្យតុលាការយុត្តិធម៌អន្តរជាតិ ICJ ដោះស្រាយដោយភាគីនីមួយៗ គោរពតាមការសម្រេចរបស់តុលាការ។ ជាលទ្ធផលទំនាក់ទំនងរវាង ឥណ្ឌូនេស៉ី និងម៉ាឡេសុី និងទំនាក់ទំនងម៉ាឡេសុី ជាមួយសឹង្ហបុរី នៅតែល្អនិងគ្មានជម្លោះតកូនតចៅ។ ការគេចវេសណាមួយមិនហ៊ានចូលតាមផ្លូវតុលាការ វាមានន័យស្មើជាមួយការប្រព្រឹត្តបទល្មើស និងការមិនគោរពច្បាប់ ក្នុងសណ្តាប់ធ្នាប់ពិភពលោកមួយដែលគោរពច្បាប់៕ Dear fellow Cambodians, whom I deeply respect and love, Esteemed foreign friends, At this point, both my compatriots and our international friends may now better understand why I decided to instruct the Ministry of Foreign Affairs and Cambodia’s representatives at the United Nations General Assembly to vote against Russia for its invasion of Ukraine in 2022 — a move that surprised many countries regarding Cambodia’s position. I have always believed that one day Thailand might repeat actions similar to those taken between 2008 and 2011. Today, we are already witnessing acts of aggression and disregard for international law. Therefore, my decision can now be understood—both by the international law-abiding community and in the context of Cambodia’s future relations with Thailand. Cambodia calls upon all states that uphold a foreign policy based on rule of law to encourage both parties to resolve disputes peacefully and in accordance with international law. Cambodia requests that law-abiding nations encourage Thailand to resolve our border disputes through the International Court of Justice (ICJ), specifically on the following four critical points: 1. The Emerald Triangle area between Cambodia, Laos, and Thailand; 2. Ta Moan Thom Temple; 3. Ta Moan Tauch Temple; 4. Ta Krabei Temple. Cambodia is not asking for weapons or ammunition leading to bloodshed with Thailand. Instead, Cambodia seeks encouragement toward peaceful resolution—through bilateral dialogue and legal means. The Cambodia-Thailand border spans over 800 kilometers. Cambodia is raising only four areas—those identified as sensitive and prone to potential armed conflict—to be resolved in advance through the courts. These four issues cannot be settled through bilateral mechanisms even within the next 100 years. Therefore, only the ICJ is capable of resolving them. Resorting to the legal path does not constitute war-mongering. It is a peaceful, lawful approach that helps prevent future bloodshed. For governments, resolving matters through the courts also provides a clearer way to explain outcomes to their own citizens—even in the face of unfavorable rulings. Among ASEAN countries, we have good examples: Indonesia and Malaysia, Singapore and Malaysia—all of whom brought territorial disputes before the ICJ and accepted the court’s rulings. As a result, diplomatic relations between these countries remain strong, with no lasting tensions. Evading legal resolution is tantamount to committing violations and disregarding the rule of law in a global order that values and respects legal norms.

The first issue concerns border disputes involving the Ta Moan Thom, Ta Moan Tauch, and Ta Krabei temple complexes, as well as the Mom Bei area. The Prime Minister stated via social media on Friday evening that Cambodia has already decided to bring these matters before the International Court of Justice (ICJ). He reiterated that Cambodia is awaiting Thailand’s response to Saturday’s JBC meeting: will Thailand agree to join Cambodia in submitting the case to the ICJ? “I would like to reconfirm to my compatriots that even if the Thai side refuses or remains silent, Cambodia will proceed unilaterally. The Ministry of Foreign Affairs and International Cooperation will send an official request to the ICJ on Sunday, June 15, 2025, regarding the disputes in these four areas,” he affirmed. The second issue that will not be discussed is the ongoing border closure. According to the Prime Minister, opening or closing border crossings does not fall within the jurisdiction of the JBC. He noted that the issue is straightforward: the border, which was unilaterally closed by the Thai military on June 7, should be unilaterally reopened to its previous status. “Cambodia does not intend to create problems that hinder cross-border travel or trade between the Cambodian and Thai people. However, Cambodia can also respond effectively to threats or external pressure,” he stressed. He underscored that Cambodia did not initiate the current situation and therefore should not be expected to end it. “What was started unilaterally must be ended unilaterally. There is no need for negotiation. Whoever starts first, ends first,” he declared. Nevertheless, the Prime Minister reiterated Cambodia’s willingness to continue working with Thailand through the JBC mechanism to complete the demarcation of the remaining sections of the shared border, excluding the four disputed areas, which Cambodia intends to resolve through the ICJ.
